Terms of Service

Effective: March 28, 2026

1. Acceptance

By creating an account or using VisiPass ("the Service"), you agree to these Terms. If you don't agree, don't use VisiPass.

2. What VisiPass Is

VisiPass is a digital business card service. You create a card with your contact information, and we generate a wallet pass (Google Wallet and Apple Wallet) and a shareable link with a QR code. That's it.

3. Subscription

VisiPass Pro costs €5.99/month. Your subscription renews automatically each month via Stripe.

  • Cancellation: Cancel anytime in the billing portal. Access continues until the end of your billing period.
  • Refunds: We don't offer prorated refunds. If you have a question about a charge, you can contact us within 7 days — this does not affect your statutory right of withdrawal under Section 12.
  • Price changes: We'll give you 30 days' notice of any price change.
  • Free trial: New accounts can try VisiPass Pro free for 14 days. After the trial period ends without subscribing, your account automatically downgrades to the free plan — no charge is made. The trial is available once per user and per email address, and can be ended at any time in the billing portal.
  • Free plan branding: Email signatures generated on the free plan include a small "Powered by VisiPass" attribution. This branding can be removed by upgrading to VisiPass Pro.

4. Acceptable Use

You may use VisiPass for legitimate professional networking. You may not:

  • Create cards impersonating another person or company
  • Include false, misleading, or illegal contact information
  • Use the service to distribute spam or unsolicited contact
  • Attempt to reverse engineer, scrape, or abuse the API
  • Create multiple accounts to circumvent subscription limits

We reserve the right to suspend accounts that violate these rules without prior notice.

5. Your Content

You own the contact information on your card. By using VisiPass, you grant us a limited license to store and display that information as needed to provide the Service (hosting your card, generating wallet passes, serving your share page).

You are responsible for ensuring the information on your card is accurate and that you have the right to share it.

6. Account Termination

You may delete your account at any time from account settings. We may suspend or terminate accounts for violations of these Terms. Upon termination, your public share page is removed and wallet passes become non-functional.

7. Availability

We aim for high availability but cannot guarantee uninterrupted service. The Service is provided "as is." We're a small team — if something breaks, we fix it fast.

8. Liability

To the maximum extent permitted by law, VisiPass is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you is capped at the amount you paid us in the three months preceding the claim.

9. Changes to These Terms

We may update these Terms. We'll notify you by email or an in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

11. Contract Formation, Language, and Storage

The contract is concluded when you complete the checkout process, click "Buy now", and we confirm your payment. The contract language is German. A copy of these Terms is always available at visipass.de/en/terms. We do not store your individual contract text separately; we recommend saving these Terms at the time of purchase (Art. 246a §1(1) No. 14, §5 EGBGB).

12. Right of Withdrawal

As a consumer (a natural person acting for purposes that are outside their trade, business, craft, or profession), you have the following right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

Exercising your right of withdrawal

To exercise your right of withdrawal, you must inform us (VisiPass, admin@visipass.de) by means of a clear statement (e.g. an email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

Exception for digital services / Loss of withdrawal right

Your right of withdrawal expires early if we have begun performance of the contract after you have expressly agreed that we begin performance before the end of the withdrawal period, and you have acknowledged that you will lose your right of withdrawal once the contract has been fully performed. You grant this consent during checkout by ticking the corresponding checkbox.

12a. Right of Withdrawal for Physical NFC Cards

When you purchase a physical NFC business card (a tangible product), the following separate right of withdrawal applies to that purchase contract under §§ 312g, 355 BGB:

Right of withdrawal

You have the right to withdraw from the purchase contract for the NFC business card within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last item.

Exercising your right of withdrawal

To exercise your right of withdrawal, you must inform us (VisiPass, admin@visipass.de) by means of a clear statement (e.g. an email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods.

Return of goods

You shall send back the NFC card(s) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal to us (VisiPass, admin@visipass.de). The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods.

No loss of right of withdrawal for physical goods

Unlike the digital subscription (§ 12), the right of withdrawal for the purchase of a physical NFC card cannot be lost early by prior consent. The right remains available for the full withdrawal period.

14. Governing Law and Jurisdiction

These Terms are governed by German law. For merchants and legal entities, the place of jurisdiction is Freiburg im Breisgau, Germany.
